TERMS AND CONDITIONS<\/h1>\n

The Parking Company – ValetParkingSchiphol.nl<\/h2>\n
\n

Article 1 – Definitions.<\/h3>\n
    \n
  1. The Parking Company:<\/strong> The Parking Company, trading under the name ValetParkingSchiphol.nl.<\/li>\n
  2. Customer:<\/strong> any natural or legal person who enters into an agreement with The Parking Company.<\/li>\n
  3. Vehicle:<\/strong> the motor vehicle offered by customer.<\/li>\n
  4. Service means<\/strong> picking up, moving, parking, storing and returning the vehicle.<\/li>\n
  5. Airport location:<\/strong> the agreed transfer or return location at or near Schiphol Airport.<\/li>\n<\/ol>\n
    \n

    Article 2 – Applicability.<\/h3>\n
      \n
    1. These general terms and conditions apply to all offers, reservations and agreements.<\/li>\n
    2. Variations are valid only if agreed in writing.<\/li>\n
    3. If any provision is found to be void or voidable, other provisions shall remain in full force and effect.<\/li>\n<\/ol>\n
      \n

      Article 3 – Formation of agreement<\/h3>\n
        \n
      1. The agreement is established upon booking via website, phone or email.<\/li>\n
      2. Customer is responsible for correct entry of vehicle and contact information.<\/li>\n
      3. The Parking Company reserves the right to refuse a reservation without reason.<\/li>\n<\/ol>\n
        \n

        Article 4 – Obligations of customer<\/h3>\n
          \n
        1. The vehicle must be technically safe, insured and MOT approved.<\/li>\n
        2. The vehicle must not contain hazardous materials, prohibited goods or valuable loose property.<\/li>\n
        3. Customer provides sufficient fuel.<\/li>\n
        4. Customer hands over a working car key.<\/li>\n
        5. Customer remains responsible for personal belongings in the vehicle.<\/li>\n<\/ol>\n
          \n

          Article 5 – Recording state vehicle and evidence<\/h3>\n

          5.1 No image recording by The Parking Company.<\/h4>\n

          The Parking Company does not take photo or video footage of vehicles upon collection or return. Recording the condition of the vehicle is the sole responsibility of customer. <\/p>\n

          5.2 Mandatory image registration by client<\/h4>\n
            \n
          1. Customer is required to take clear photos and\/or a short video when returning and picking up the vehicle at the airport location.<\/li>\n
          2. At a minimum, these images should include:\n
              \n
            • front<\/li>\n
            • back<\/li>\n
            • left side<\/li>\n
            • right side<\/li>\n
            • rims<\/li>\n
            • mirrors<\/li>\n
            • bumpers<\/li>\n<\/ul>\n<\/li>\n
            • The images must be demonstrably taken at the airport location and at the time of transfer or receipt.<\/li>\n<\/ol>\n

              5.3 Evidential value<\/h4>\n
                \n
              1. Images not taken at the airport site or not traceable to the transfer moment will not be accepted as evidence.<\/li>\n
              2. If Customer fails to take or preserve images, the entire risk of evidence shall be borne by Customer.<\/li>\n<\/ol>\n

                5.4 Effect on damage claims<\/h4>\n

                In the absence of sufficient footage of both the time of submission and receipt, The Parking Company may reject a claim for lack of evidence.<\/p>\n

                \n

                Article 6 – Parking and custody<\/h3>\n
                  \n
                1. The vehicle will be parked at a location designated by The Parking Company.<\/li>\n
                2. The Parking Company exercises normal care when storing vehicles.<\/li>\n
                3. Mileage movements may occur for logistical purposes.<\/li>\n<\/ol>\n
                  \n

                  Article 7 – Duty to complain and claims for damages.<\/h3>\n

                  7.1 Direct inspection on return<\/h4>\n

                  Customer must inspect the vehicle immediately upon receipt at the airport location.<\/p>\n

                  7.2 Duty to Report<\/h4>\n
                    \n
                  1. Any alleged new damage should be reported immediately and before leaving the airport site.<\/li>\n
                  2. The report is recorded on a return form whenever possible.<\/li>\n<\/ol>\n

                    7.3 Written confirmation<\/h4>\n

                    A written report with photo\/video evidence must be submitted by e-mail no later than 24 hours after observation.<\/p>\n

                    7.4 Consequence of not reporting<\/h4>\n

                    If Customer fails to report in a timely manner, the right to compensation shall in principle lapse, unless Customer makes it plausible that timely reporting was not reasonably possible.<\/p>\n

                    7.5 Evidence requirements claim<\/h4>\n

                    A claim will only be considered if customer delivers:<\/p>\n

                      \n
                    • clear description of the damage;<\/li>\n
                    • photo\/video upon submission and receipt in accordance with Article 5;<\/li>\n
                    • (if any) return form.<\/li>\n<\/ul>\n
                      \n

                      Article 8 – Liability<\/h3>\n
                        \n
                      1. The Parking Company is only liable for demonstrable direct damages incurred during the provision of services for which sufficient evidence has been provided in accordance with Articles 5 and 7.<\/li>\n
                      2. Liability is limited to the amount paid by insurance with a maximum of \u20ac500 per vehicle.<\/li>\n
                      3. The Parking Company is not liable for:\n
                          \n
                        • pre-existing damage;<\/li>\n
                        • mechanical or electrical defects;<\/li>\n
                        • loss of loose property;<\/li>\n
                        • indirect or consequential damages;<\/li>\n
                        • force majeure situations.<\/li>\n<\/ul>\n<\/li>\n
                        • These limitations do not apply in cases of willful misconduct or gross negligence.<\/li>\n<\/ol>\n
                          \n

                          Article 9 – Payment<\/h3>\n
                            \n
                          1. Payment is made in advance or at the start of services. This can only be done by pin at the start, we do not accept cash. <\/li>\n
                          2. Failure to pay may result in denial of service.<\/li>\n<\/ol>\n
                            \n

                            Article 10 – Cancellation.<\/h3>\n
                              \n
                            1. Free cancellations may be made up to 24 hours prior to start time.<\/li>\n
                            2. A fee may be due within 24 hours.<\/li>\n<\/ol>\n
                              \n

                              Article 11 – Force majeure<\/h3>\n

                              The Parking Company is not liable for delays or damages due to force majeure, including extreme weather conditions, strikes, traffic problems or government actions.<\/p>\n

                              \n

                              Article 12 – Privacy and camera use.<\/h3>\n
                                \n
                              1. Camera images at parking locations can be used for security.<\/li>\n
                              2. Processing of personal data is done in accordance with AVG legislation.<\/li>\n<\/ol>\n
                                \n

                                Article 13 – Applicable law and disputes.<\/h3>\n
                                  \n
                                1. All agreements are governed by Dutch law.<\/li>\n
                                2. Disputes shall be submitted to the competent court in the Netherlands.<\/li>\n<\/ol>\n
