TERMS AND CONDITIONS
The Parking Company – ValetParkingSchiphol.nl
Article 1 – Definitions.
- The Parking Company: The Parking Company, trading under the name ValetParkingSchiphol.nl.
- Customer: any natural or legal person who enters into an agreement with The Parking Company.
- Vehicle: the motor vehicle offered by customer.
- Service means picking up, moving, parking, storing and returning the vehicle.
- Airport location: the agreed transfer or return location at or near Schiphol Airport.
Article 2 – Applicability.
- These general terms and conditions apply to all offers, reservations and agreements.
- Variations are valid only if agreed in writing.
- If any provision is found to be void or voidable, other provisions shall remain in full force and effect.
Article 3 – Formation of agreement
- The agreement is established upon booking via website, phone or email.
- Customer is responsible for correct entry of vehicle and contact information.
- The Parking Company reserves the right to refuse a reservation without reason.
Article 4 – Obligations of customer
- The vehicle must be technically safe, insured and MOT approved.
- The vehicle must not contain hazardous materials, prohibited goods or valuable loose property.
- Customer provides sufficient fuel.
- Customer hands over a working car key.
- Customer remains responsible for personal belongings in the vehicle.
Article 5 – Recording state vehicle and evidence
5.1 No image recording by The Parking Company.
The Parking Company does not take photo or video footage of vehicles upon collection or return. Recording the condition of the vehicle is the sole responsibility of customer.
5.2 Mandatory image registration by client
- Customer is required to take clear photos and/or a short video when returning and picking up the vehicle at the airport location.
- At a minimum, these images should include:
- front
- back
- left side
- right side
- rims
- mirrors
- bumpers
- The images must be demonstrably taken at the airport location and at the time of transfer or receipt.
5.3 Evidential value
- Images not taken at the airport site or not traceable to the transfer moment will not be accepted as evidence.
- If Customer fails to take or preserve images, the entire risk of evidence shall be borne by Customer.
5.4 Effect on damage claims
In the absence of sufficient footage of both the time of submission and receipt, The Parking Company may reject a claim for lack of evidence.
Article 6 – Parking and custody
- The vehicle will be parked at a location designated by The Parking Company.
- The Parking Company exercises normal care when storing vehicles.
- Mileage movements may occur for logistical purposes.
Article 7 – Duty to complain and claims for damages.
7.1 Direct inspection on return
Customer must inspect the vehicle immediately upon receipt at the airport location.
7.2 Duty to Report
- Any alleged new damage should be reported immediately and before leaving the airport site.
- The report is recorded on a return form whenever possible.
7.3 Written confirmation
A written report with photo/video evidence must be submitted by e-mail no later than 24 hours after observation.
7.4 Consequence of not reporting
If Customer fails to report in a timely manner, the right to compensation shall in principle lapse, unless Customer makes it plausible that timely reporting was not reasonably possible.
7.5 Evidence requirements claim
A claim will only be considered if customer delivers:
- clear description of the damage;
- photo/video upon submission and receipt in accordance with Article 5;
- (if any) return form.
Article 8 – Liability
- The Parking Company is only liable for demonstrable direct damages incurred during the provision of services for which sufficient evidence has been provided in accordance with Articles 5 and 7.
- Liability is limited to the amount paid by insurance with a maximum of €500 per vehicle.
- The Parking Company is not liable for:
- pre-existing damage;
- mechanical or electrical defects;
- loss of loose property;
- indirect or consequential damages;
- force majeure situations.
- These limitations do not apply in cases of willful misconduct or gross negligence.
Article 9 – Payment
- Payment is made in advance or at the start of services. This can only be done by pin at the start, we do not accept cash.
- Failure to pay may result in denial of service.
Article 10 – Cancellation.
- Free cancellations may be made up to 24 hours prior to start time.
- A fee may be due within 24 hours.
Article 11 – Force majeure
The Parking Company is not liable for delays or damages due to force majeure, including extreme weather conditions, strikes, traffic problems or government actions.
Article 12 – Privacy and camera use.
- Camera images at parking locations can be used for security.
- Processing of personal data is done in accordance with AVG legislation.
Article 13 – Applicable law and disputes.
- All agreements are governed by Dutch law.
- Disputes shall be submitted to the competent court in the Netherlands.
